Members of MWBU ‘’Nezavisnost’’ of ‘’Le Belier’’ d.o.o. Kikinda returned to work

By the Decision of the Labor Inspection for the Administrative District of Northern Banat, with headquarters in Kikinda, proceeding on the request of the attorney-at-law, Milos Nikolic, as well as members of ‘’Nezavisnost’’ Union, employees have been returned to work until the termination of legal proceedings. Their Labor Contract was terminated on September 2 2008 with the justification of Art. 179, paragraph 1, item 3. of the Labor Law, which says that if an employee does not obey work discipline regulated by Employer’s Act, namely, if his conduct is such that he cannot continue work with the Employer and that thereby the Employer has not established, through General Act or Labor Contract, what could be considered disobeying work discipline, and it hasn’t stated a specific action either.

The Labor Contract has been allegedly terminated for members of ‘’Nezavisnost’’ Union, because of insufficient performance on their jobs, non-observance of operating procedure, as well as a lack of interest in their jobs. Due to Employer’s omission, the Labor Inspection has reached a Decision by which the Labor Contract termination has been postponed until the Court’s Decision becomes legally binding. The Employer is obligated to return employees to their workplaces upon receipt of this Decision and file a registration form for the compulsory social insurance.
